1. Introduction

Welcome to Hamzo, operated by Upwear Nepal Pvt. Ltd. (“Company”, “we”, “our”, or “us”).
By accessing or using the Hamzo mobile application or website (www.hamzo.app), you agree to comply with and be bound by these Terms and Conditions (“Terms”).
If you do not agree to these Terms, please do not use our services.


2. Services Provided

Hamzo is a super delivery platform offering various on-demand services, including:

  • Food delivery

  • Grocery delivery

  • Pharmacy delivery

  • E-commerce products

  • Parcel and courier services

  • Car and vehicle rental

Our platform connects customers, delivery partners, and vendors/merchants for seamless delivery and ordering experiences.


3. User Accounts

  • You must be at least 18 years old to create an account.

  • You agree to provide accurate and complete information during registration.

  • You are responsible for maintaining the confidentiality of your account and password.

  • Any unauthorized use of your account should be immediately reported to support@hamzo.app.


4. Ordering and Payments

  • All orders placed through Hamzo are confirmed only after acceptance by the respective vendor or service provider.

  • Hamzo currently supports Cash on Delivery (COD) as the only payment option.

  • You agree to pay the full amount at the time of delivery.

  • Prices displayed on the app include applicable taxes (unless stated otherwise).


5. Cancellations and Refunds

  • Orders once placed cannot be canceled after confirmation.

  • Refunds are applicable only if:

    • The order is canceled by the vendor or delivery partner.

    • The product is not delivered within the committed time due to service failure.

  • Refunds (if applicable) will be processed within 7 business days through the original payment method or store credit.


6. Delivery Policy

  • Delivery time estimates are provided for convenience and may vary due to traffic, weather, or vendor delays.

  • Our delivery partners will make reasonable efforts to reach your location.

  • If you fail to accept delivery after multiple attempts, Hamzo reserves the right to cancel the order.


7. Vendor and Partner Terms

  • Vendors must ensure product quality, freshness (for food and groceries), and accurate pricing.

  • Hamzo is not liable for the quality, quantity, or safety of items provided by third-party vendors.

  • Delivery partners are independent contractors, not employees of Hamzo.


8. Car Rental Terms

  • Users must hold a valid driver’s license (for self-drive options).

  • Damage or misuse of rented vehicles will result in repair or penalty charges as determined by the provider.

  • Hamzo acts only as a facilitator between renters and vehicle providers.


9. Limitation of Liability

  • Hamzo acts as a marketplace platform, not a producer, retailer, or manufacturer.

  • We are not responsible for:

    • Product defects, expired goods, or vendor errors.

    • Delays, damages, or losses arising from third-party negligence.

  • Our total liability for any claim shall not exceed the total amount paid for the specific order.


10. User Conduct

You agree not to:

  • Misuse the platform for fraudulent or unlawful activities.

  • Post harmful, abusive, or misleading content.

  • Attempt to interfere with Hamzo’s systems, security, or data.

Violation of these rules may lead to account suspension or permanent ban.


11. Intellectual Property

  • All logos, trademarks, designs, and content on Hamzo are the property of Upwear Nepal Pvt. Ltd.

  • You may not use, copy, or distribute any part of our content without written permission.


12. Privacy Policy

Your personal data is collected and processed in accordance with our Privacy Policy, available within the Hamzo app or at www.hamzo.app/privacy.


13. Termination

We may suspend or terminate your account without prior notice if you violate these Terms or engage in misuse of our platform.


14. Changes to Terms

Hamzo reserves the right to update or modify these Terms at any time.
Updated Terms will be effective upon posting on our app or website. Continued use of our services constitutes acceptance of the revised Terms.


15. Governing Law

These Terms shall be governed by and construed under the laws of Nepal.
In case of disputes, the courts of Dhangadhi, Nepal shall have exclusive jurisdiction.
